It is with sadness and a heavy heart I send this message to my loved ones, we lost my appeal. I am shocked they were able to decide in just a few days when we were sure it would take several months.
I suspose this proves i am in fact a P.O.W. and that darker forces are at work here. However, my attorney says not to give up hope as she belives they are in error, just as [the judge who sentenced me, Marilyn] Patel was.
She will file a blank appeal to to 9th Circuit Panel of Judges. If we fail there, then we will go to the U.S. Supreme Court. The original court went against a supreme court ruling to do what they did so there is still lots of reson for hope, it will just take time.
I thank you all for being there for me thru all of this. May Jah continue to bless us all. I love and miss each if you very much. Again, thank you.

So Eddy didn’t get the “strict scrutiny” which the UDV case got….. only the “compelling interest” test.
Do you know what NIDA says about the diversion of Synthetic Cannabinoids (the ones turning up in the ‘incense’, like Spice)?
Now, keep in mind that the inventor of one of these substances (a medical researcher here in the states), warns that these (synthetic) substances have a much higher chance of abuse because of their singular chemical composition, and may have unseen-as-yet side effects including the possibility of death from overdose (not possible with vegetable cannabinoids). The answer to my question is below, directly from a Federal Agency (pay special attention to the last line).

A NIDA spokesperson defended the agency’s funding for Huffman’s research, saying that studying “artificial variations of brain chemicals … has yielded major research and clinical advances.”
Research into cannabinoids, said the spokesperson, “has the potential to usher in the next generation of pain medications,” as well as possible treatments for obesity and multiple sclerosis.”
“The scientific record demonstrates that the cost of discontinuing the pursuit of potentially life-saving medications, because such compounds could be illegally diverted and abused, would be unacceptably high.”
Dear Eddy, iam a 59 yr. old enthusiast from the east coast and i followed your story in High Times magazine. Eddy, I am a medicinal patient in Michigan and like the poster above, I agree that Michigan would not be like it is today if it wasn’t partially because of you and what you stand for. You’re a great man Eddy, and you don’t belong in prison. You will have a huge supportive group on your release date. Hang in there, Bud.
